PILATES METHOD ALLIANCE, PMA, PILATES DAY, PILATES PURE AND SIMPLE, THE HUNDRED!, THE PILATES JOURNAL, CAMP PILATES, and other marks indicated on our website and the logo forms of the foregoing marks, are trademarks and/or service marks (the “Trademarks”) of Pilates Method Alliance, Inc. a not for profit corporation organized and existing under the laws of the State of Florida (the “PMA”). The Trademarks may be registered in the United States or in other jurisdictions including internationally. PMA's trademarks, service marks and trade dress may not be used in connection with any product or service that is not affiliated with the PMA in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits the PMA. All other trademarks not owned by the PMA or its subsidiaries that appear on this website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by the PMA.

Policy Towards Children
We do not sell products for purchase by children. If you are under 18, you may use pilatesmethodalliance.org only with the involvement of a parent or guardian.

Jurisdiction and Venue
By using this website, and any products or services purchased from the PMA, you agree that any legal action brought against the PMA shall be governed by the laws of the State of Florida, for contracts that are entered into and performed wholly within the State of Florida, without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made on the pilatesmethodalliance.org website shall be in an appropriate federal or state court located in the county of the PMA’s home office at the time of instituting such suit, presently Dade County, Florida.

Electronic and Facsimile Communications
When you visit pilatesmethodalliance.org or send e-mails or faxes to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this website. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You further understand that by providing your fax number(s) and email address(es), that you consent to receive faxes and emails sent by or on behalf of the PMA and that you have the requisite authority to give this permission to the PMA on behalf of yourself and your company.

Copyright & Trademark Complaints
The PMA respects the intellectual property of others. If you believe that your copyrighted materials have been copied in a way that constitutes copyright infringement, or if you believe that use of the trademarks on our site infringes a trademark right, please follow our Notice and Procedure for Making Claims of Copyright and Trademark Infringement.

PRIVACY POLICY
The PMA is committed to protecting your privacy online. Our primary goal in collecting personalized and company information is to provide the PMA’s membership with superior online services and to provide information to the general public about the PMA and its members in conformity with the PMA’s Mission and Goals (see: http://www.pilatesmethodalliance.org/whatispma.html). In summary, we use contact and related information supplied to us as follows:

  • Members: to provide information to the public, as provided by you about your services, your facility and qualifications for listing and information in our searchable database.
  • Goods and Service Customers: to fill orders, contact purchasers to inform them of their order status, to send promotional information, to provide update information, to enhance the operation of our site and to administer our system.
  • Conference Registrants: the PMA utilizes the services of a third party company, Cvent Inc. 200 N. Glebe Road, Arlington, VA 22203, Tel: 703.226.3555, Fax: 703.226.3501, www.cvent.net for managing and facilitating the registration of Conference Registrants. Conference Registrants provide information as requested for purposes of registering for a conference including the specification of which seminars you wish to attend while attending the conference. Personal financial information such as credit card information and the like will only be disclosed for purposes of processing such credit card information in the registration process. It will not be disclosed to any third party for any other purpose. This notice describes our privacy policy. By visiting the PMA website, you are accepting the practices described in this Privacy Notice.

What personal information about you do we collect?
Information you give to us: We receive and store information that you supply to us via our web site and regular operations. This includes information regarding an order such as your name, company name, email address, billing address, mailing address, billing information, credit card number, credit card expiration date, shipping address, website usage password, electronic newsletters opt-in options and other opt-in notifications that you authorize, including but not limited to Third Party opt-in options. This may also include information provided by you to us via email, phone customer service, or questionnaires.

Information about you given to us by third parties: Although we do not currently, we may in the future work with certain companies who, in conjunction with their own customer incentive programs, may provide information about you to use including your account information and purchasing authorization.

Information automatically collected: We receive and store certain types of information whenever you come to our site. For example, as is common practice, we use "cookies" and similar technology, to obtain and determine certain information when your browser accesses the PMA website pilatesmethodalliance.org including, but not limited to, the Internet Protocol (IP) address used to connect your computer to the internet, email address, browser type and version, operating system and platform.

How is the personal information used?
Information about our members and customers is a very important part of our organization, as a trade secret and we are not in the business of selling such information to others. We will only share such customer information with entities who have agreed to be bound by the terms and conditions of our privacy policies as outlined herein and for which you have authorized disclosure to such third parties. The PMA does not share customer information with any non-affiliated companies. We do not sell, trade or rent your personal information to others. However, corporate members of the PMA are entitled to utilize the PMA mailing list but such usage is controlled and distributed by the PMA directly or through an authorized company without providing such information directly to the corporate member. Additionally, corporate members are entitled to receive the name and address of all Conference Registrants which is made available to the corporate members by the PMA pursuant to such policies and non-disclosure requirements. Information is only shared with entities working in concert with the PMA.

Should the PMA be sold or transferred to another entity, customer information is likely to be part of the sales or transfer. We may send offers to selected groups of PMA customers and members on behalf of other businesses. When we do this, we do not give that business your name and address. If you do not want to receive such offers, please indicate that you are opting out of such notification in your user profile. Other than as set out above, you will receive notice when information about you might go to third parties, and you will have an opportunity to choose not to share the information.

What if I link to a third-party web site from the PMA website?
When you click links and/or banners that take you to third party web sites, you will be subject to the third parties' privacy policies. While we support the protection of privacy on the internet, we cannot be responsible for the actions of third parties and urge you to read and understand the privacy policies of such sites.

How does the PMA protect customer information?
The PMA uses the latest encryption technology to keep your personal information safe. All your ordering information-including your name, address and credit card number-is encrypted using a secure server for maximum security. Credit card transactions are handled by an authorized clearing company, which receives the credit card number and other personal identifying information in a fully secured environment only to verify the credit card numbers and process transactions. It is important for you to protect against unauthorized access to your password and to your computer. Be sure to sign off when finished using a shared computer.

This Privacy Policy was last modified on May 12, 2004 and provisions may be changed, modified, added or removed at any time and such changes will become effective immediately upon posting.

What About Cookies?
Cookies are alphanumeric identifiers that we transfer to your computer's hard drive through your Web browser to enable our systems to recognize your browser and to provide features for using the PMA's website . The "help" portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. However, cookies allow you to take full advantage of some of the PMA's website features, and we recommend that you leave them turned on.

Notice and Procedure for Making Claims of Copyright and Trademark Infringement
If you believe that your copyrighted materials have been copied in a way that constitutes copyright infringement, or if you believe that use of the trademarks on our site infringes a trademark right, please provide the PMA's agent the written information specified below. Please note that this procedure is exclusively for notifying the PMA that your material has been infringed.

  • An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or trademark interest;

  • A description of what you claim has been infringed upon;

  • A description of where the material that you claim is infringing is located on the PMA website;

  • Your address, telephone number and e-mail address;

  • A statement by you that you have a good-faith belief that the disputed use is not authorized by the owner, its agent, or the law;

  • A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the owner or authorized to act on the owner's behalf.

WAIVER & RELEASE:
The Pilates Method Alliance, Inc. (PMA) will be videotaping and recording its National Educational Conferences, including, but not limited to lectures, round table discussions, mat classes and other meetings during the conference (PMA Conference). The PMA will make these materials available in the future, in electronic form including, audio tapes, video tapes and DVD's and like medium. Additionally, these materials will be made available as part of the PMA archives. By signing up as a Conference Registrant, you understand that the PMA Conference will be recorded and hereby release to the PMA any and all rights that you may have for the PMA to release and otherwise redistribute the recorded materials, for profit or not for profit, in any form and in any manner. In consideration of your participation in any workshops, private workouts, or group classes, for yourself, and your heirs and assigns, hereby release the PMA, and all facilities and locations utilized by the PMA for its conferences, and for each of the foregoing, their owners, employees, landlords, agents, officers, directors, presenters, participants and assigns (Released Parties), from any claims, demands, and causes of action whatsoever, arising from my participation in the PMA Conference. I fully recognize and understand that I may become injured as a result of my attendance and/or participation in the PMA Conference and hereby release the Released Parties from any and all liability now or in the future.

PROHIBITION ON PHOTOGRAPHING AND RECORDING:
arising from my participation in the PMA Conference. I fully recognize and understand that The Pilates Method Alliance, Inc. (PMA) can not and will not permit the taking of photographs, audio or video taping of any conferences held by or sponsored by the PMA. Should an individual be found photographing, video graphing or taping of any kind without the express written permission of the PMA, the PMA will confiscate all such equipment and media containing such unauthorized recording, and the person shall thereafter be banned from attending any PMA conference.
